HEY NOW RECORDS PRIVACY POLICY

This Privacy Policy explains how Hey Now Records, LLC (“Hey Now Records,” “we,” “our,” or “us”) collects, uses, discloses, and otherwise processes personal information in connection with heynowrecords.com and related online services, features, content, and communications (collectively, the “Services”). The Services may include the Hey Now Records ecommerce store, account and order activity if offered, email and optional telephone signups, customer service, artist campaigns, games, activations, advertising and analytics, and sweepstakes and promotions.

Scope of This Privacy Policy

This Privacy Policy applies to personal information collected through the Services, including through heynowrecords.com, the ecommerce store, account or order activity if offered, email and optional telephone signups, customer service interactions, artist campaigns, games, activations, sweepstakes and promotions, and advertising and analytics technologies operating on or in connection with the Services.

Purchases made through the Hey Now Records ecommerce store are processed by Sparkart Group, Inc. (“Sparkart”), which operates the store and acts as the merchant of record for those purchases. When you place an order, Sparkart collects your name, contact details, billing and shipping information, payment information, and order and transaction information, and processes that information as the seller of record to complete your purchase; process payments, refunds, and chargebacks; calculate and remit taxes; prevent fraud; fulfill orders; and maintain transaction records as required by law. Sparkart’s processing of personal information in connection with your purchase is also governed by Sparkart’s privacy policy, available at https://services.sparkart.net/legal/privacy. Sparkart may share order and transaction information with Hey Now Records as described in this Privacy Policy. Notwithstanding any provision of Sparkart’s privacy policy, Sparkart’s collection, use, and processing of personal information obtained in connection with purchases made through the Hey Now Records ecommerce store remains subject to the restrictions set forth in the Services Agreement between Hey Now Records and Sparkart. To the extent Sparkart’s privacy policy is inconsistent with those restrictions, the Services Agreement controls.

This Privacy Policy does not apply to third-party websites, applications, or services linked from or integrated with the Services. Hey Now Records is not responsible for the privacy practices of third parties, and visitors are encouraged to review the privacy policies of any third-party services before providing personal information.

Information We Collect

Hey Now Records collects and processes the categories of personal information described below, depending on the Services and features offered and how you interact with them.

Information Provided Directly

Names and contact details, including email addresses and telephone numbers, when you provide them.
Billing and shipping information associated with orders, including billing and shipping addresses.
Payment information processed by payment providers in connection with orders.
Orders and transactions, including purchase history, product selections, purchase amounts, order status, returns, refunds, exchanges, and related records.
Account information, if the Services offer accounts, such as account preferences and activity.
Customer-service communications, including the content of inquiries and responses.
Consent and marketing preferences, including email and SMS opt-in and opt-out records.

Information Collected Automatically

Device and browser information, such as device type, operating system, browser type, and browser version.
IP address and approximate location derived from IP address.
Website, game, and service usage information, including interactions with features actually offered.
Information collected through cookies, pixels, web beacons, local storage, and similar technologies, including identifiers, session information, and activity on the Services.
Analytics and advertising information collected through tools such as Google Analytics and the Meta pixel, including audience data, advertising interactions, conversion events, and measurement information.

Information from Other Sources

Hey Now Records may receive personal information from third-party sources involved in providing or supporting the Services, including:

Sparkart, as operator of the ecommerce store and merchant of record, and other ecommerce platform providers and payment providers, in connection with order processing, fulfillment, customer service, and fraud prevention.
Advertising and analytics partners, including audience, conversion, and measurement data.
Social media platforms when you interact with Hey Now Records content or advertising on those platforms.
Service providers that assist with customer support, shipping, logistics, marketing communications, security, analytics, or related operations.

How We Use Personal Information

Hey Now Records uses personal information for the following purposes, depending on the Services and features offered:

Providing and operating the Services, including processing and fulfilling orders; managing accounts, if offered; providing access to website content, music, artist campaigns, games, and activations; and providing customer service and support.
Ecommerce and transactions, including processing payments through payment providers; verifying billing and shipping details; managing order logistics; coordinating with fulfillment and shipping providers; and maintaining transaction records.
Communications, including sending transactional messages such as order confirmations, shipping notifications, and account-related messages. Hey Now Records sends marketing email only with consent or as otherwise permitted by law and may send SMS only after separate affirmative consent, as described in the Communications Choices section.
Advertising and analytics, including measuring advertising campaigns; analyzing website traffic and usage; building and managing advertising audiences; delivering targeted and cross-context behavioral advertising; and personalizing content and offers.
Sweepstakes and promotions, including administering a promotion; verifying eligibility; selecting and notifying winners; fulfilling prizes; and complying with tax reporting, legal, and regulatory requirements.
AI-enabled processing and internal business operations, as described in the AI-Enabled Processing section.
Security and fraud prevention, including detecting, investigating, and preventing fraudulent transactions, unauthorized access, abuse, and other potentially illegal or harmful activity.
Legal and regulatory compliance, including responding to legal process and governmental requests and establishing, exercising, or defending legal claims.
Business operations, including administration, auditing, reporting, quality assurance, and business continuity.

How We Disclose Personal Information

Hey Now Records may disclose personal information to the following categories of recipients, as needed for the purposes described in this Privacy Policy:

Sparkart and other ecommerce, payment, fulfillment, shipping, logistics, warehouse, and inventory providers. Sparkart, as merchant of record, receives and processes order and payment information as described in the Scope of This Privacy Policy section. These providers may receive contact details, billing and shipping information associated with orders, payment information for processing, and order and transaction information to process, fulfill, ship, track, refund, and support orders.
Marketing and communications providers. These providers may receive contact details and consent and marketing preferences to send transactional or marketing communications on behalf of Hey Now Records.
Advertising and analytics providers, including Google Analytics and Meta. These providers may receive device, browser, IP, approximate location derived from IP, cookie, pixel, usage, and advertising information for analytics, audience building, personalization, advertising, and measurement. The Meta pixel is used for audience building and may send Meta identifiable or pseudonymous pixel or API information for personalization, measurement, and advertising. Disclosures for targeted or cross-context behavioral advertising may be treated as a sale or sharing under certain state laws even when no money is paid.
Customer-support providers. These providers may receive contact details, order information, and customer-service communications to respond to inquiries and resolve issues.
AI-enabled service providers. Approved AI-enabled tools, including Mika, may process limited personal information, including limited order or operational data, solely to support the Services and related analytics, customer support, fraud prevention, and internal business operations. Any new use of personal information or AI feature affecting personal information requires Hey Now Records’ prior written approval, as described in the AI-Enabled Processing section.
Internal communication and collaboration tools. Limited personal information may be accessible through tools used by Hey Now Records, Sparkart (as operator of the ecommerce store), and their authorized personnel for operational purposes.
Other service providers and vendors. Hey Now Records may disclose personal information to providers supporting hosting, storage, security, technical infrastructure, and related operations. These providers may process identifiable, pseudonymous, telemetry, aggregated, or deidentified data only as needed to provide those services and subject to applicable law and contractual restrictions.
Legal and compliance disclosures. Hey Now Records may disclose personal information when required or permitted by law, legal process, or governmental request, or as necessary to protect the rights, property, or safety of Hey Now Records, its customers, or others, or to establish, exercise, or defend legal claims.
Business transfers. If Hey Now Records is involved in a merger, acquisition, reorganization, sale of assets, bankruptcy, or similar transaction, personal information may be transferred as part of that transaction, subject to applicable law.
With your direction or as otherwise permitted by law. Hey Now Records may disclose personal information when you request or authorize the disclosure or as otherwise described in this Privacy Policy.

Cookies, Tracking Technologies, and Targeted Advertising

Hey Now Records and third-party partners use cookies, pixels, web beacons, local storage, and similar technologies to collect information automatically when visitors access or use the Services. These technologies serve the following purposes:

Essential Operations. Maintaining session state, enabling ecommerce functionality, remembering preferences, and supporting security measures.
Analytics. Google Analytics and other analytics tools collect usage data to help Hey Now Records understand how visitors interact with the Services, including page views, traffic sources, and user behavior patterns.
Advertising and Audience Building. The Meta pixel and similar technologies operate on the Services to build and manage advertising audiences, measure the effectiveness of advertising campaigns, enable personalization, and support cross-context behavioral advertising. Meta may receive identifiable or pseudonymous pixel and API data for these purposes.
Measurement and Conversion Tracking. Pixels and tags track actions taken after viewing or interacting with an advertisement to measure advertising performance and attribute conversions.

Some of the activities described above, including targeted advertising, audience building, and cross-context behavioral advertising, may constitute a "sale" or "sharing" of personal information under certain U.S. state privacy laws, even where no monetary payment is exchanged. Hey Now Records does not sell personal information for monetary consideration. However, the disclosure of personal information to advertising and analytics partners as described in this section may be treated as a sale or sharing under applicable law.

Most web browsers allow visitors to manage cookie preferences through browser settings, including blocking or deleting cookies. Disabling certain cookies may affect the functionality of the Services.

Do Not Track. We do not currently employ a process for automatically responding to “Do Not Track” (“DNT”) signals sent by web browsers, mobile devices, or other mechanisms. Per industry standards, third parties may be able to collect information, including personal information, about your online activities over time and across different websites or online services when you use the Services.

Global Privacy Control. You can use the Global Privacy Control (“GPC”) through a supported browser to signal certain of your opt-out preferences. You may opt-out of the processing of your Personal Information for purposes of targeted advertising or certain sales of your personal information by broadcasting the Global Privacy Control Signal through a supported browser. If you use the GPC, we will process your request for your browser, but it will not apply outside of that browser to your device. You will need to use the GPC for each browser you use to access the website If you clear your cookies in your browser after using the GPC, you will need to use the GPC again for us to process your opt out for that browser.

Google Analytics. We use Google Analytics to collect and process information about your use of the Services. Google sets cookies on your browser or device, and then your web browser will automatically send information to Google. Google uses this information to provide us with reports that we use to better understand and measure how users interact with our Services.

Meta Pixel. We use the Meta Pixel (formerly Facebook Pixel), a tool provided by Meta Platforms, Inc. This technology helps us understand actions that visitors take on our Services after viewing or interacting with our ads on Facebook or Instagram, measure the effectiveness of our marketing campaigns, and create audiences for future advertising. The information collected through the Meta Pixel may include your IP address, browser information, and information about your actions with our Services (such as pages visited) and may be linked by Meta to your Facebook or Instagram account if you have one. Meta uses this information in accordance with its own Data Policy. You may opt out of Meta's use of cookies and pixels by visiting Meta’s Ad Settings.

AI-Enabled Processing

Hey Now Records may use service providers and approved AI-enabled tools, including Mika, to provide and support the Services, including analytics, customer support, fraud prevention, and internal business operations. In the course of providing these services, limited personal information, including order data and transaction information, may be processed through those tools on behalf of Hey Now Records.

Hey Now Records maintains contractual restrictions on the use of personal information by service providers. Service providers that operate approved AI-enabled tools, including Mika, may use Hey Now Records’ personal information only to provide services to Hey Now Records and may not use it to train generalized AI models or improve products or services for unrelated clients. Any new use of personal information or AI feature affecting personal information requires Hey Now Records’ prior written approval. Hey Now Records retains personal information processed through AI-enabled tools only as long as reasonably necessary for the purposes described in this Privacy Policy or as required by applicable law.

Hey Now Records does not use AI-enabled tools to make decisions that produce legal or similarly significant effects on individuals.

Communications Choices

Hey Now Records may communicate with individuals through a variety of channels, including email and SMS (text message). The choices described below apply to marketing communications and do not affect transactional or service-related messages such as order confirmations, shipping updates, and account notifications.

Email Marketing

Hey Now Records sends marketing emails only to individuals who have provided consent or whose email address was collected in connection with a transaction or the Services where marketing communications may be expected. Recipients may opt out of marketing emails at any time by following the unsubscribe instructions included in each marketing email. Opting out of marketing emails does not affect transactional or service-related communications.

SMS (Text Message) Communications

Hey Now Records may offer the option to receive promotional or informational text messages. Consent to receive SMS marketing communications is separate from email marketing consent and is not a condition of purchase or use of the Services. Message and data rates may apply. Recipients may opt out of SMS marketing communications at any time by following the instructions included in text messages, including replying STOP where supported. After opting out, a confirmation message may be sent to confirm the opt-out request.

Providing a telephone number through the Services and opting in to receive text messages constitutes consent to receive SMS communications from Hey Now Records. This consent is voluntary and may be withdrawn at any time as described above.

Visitors may update marketing preferences and manage communication choices by contacting Hey Now Records at privacy@heynowrecords.com.

Sweepstakes and Promotions

Hey Now Records may offer sweepstakes, contests, and other promotional activities from time to time. Participation in these promotions may require the submission of additional personal information, including name, contact details, eligibility information, and other details necessary for administration, winner selection, notification, prize fulfillment, and tax reporting.

Sweepstakes and promotion entry information is collected and used solely to facilitate the applicable promotion under the direction of Hey Now Records. Each promotion may be governed by its own official rules, which will specify the terms and conditions of participation, including any additional privacy disclosures applicable to that promotion.

Hey Now Records and authorized service providers involved in administering the promotion may process entry information for the duration of the promotion and as required for prize fulfillment, tax reporting, legal compliance, and dispute resolution.

Data Retention and Security

Retention. Hey Now Records retains personal information for as long as reasonably necessary and proportionate to achieve the purposes for which the personal information was collected or processed, or for another disclosed purpose that is compatible with the context in which the personal information was collected. The specific retention period depends on the nature of the information, the purposes for which we use it, and applicable legal requirements. personal information is no longer needed, we will securely delete or anonymize it in accordance with our data retention policies and applicable law.

Security. When handling information, we utilize administrative, technical, and physical safeguards designed to protect information from unauthorized access, disclosure, alteration, or loss. However, no internet transmission is ever fully secure, and we cannot guarantee that information transmitted via our Services will remain confidential at all times.

Children’s Privacy

The Services are not directed to children under the age of 13. Hey Now Records does not knowingly collect personal information from children under the age of 13. Hey Now Records does not knowingly sell or share personal information of consumers under 16 years of age. If Hey Now Records becomes aware that we have collected personal information from a child under 13 without parental consent, we will take steps to delete that information promptly.

Parents or guardians who believe that a child under 13 has provided personal information to Hey Now Records without consent may contact Hey Now Records at privacy@heynowrecords.com to request deletion of the information.

External Links and Third-Party Services

The Services may contain links to third-party websites, applications, social media platforms, and other online services that are not owned or controlled by Hey Now Records. This Privacy Policy does not apply to any third-party services, other than the Hey Now Records ecommerce store operated by Sparkart as described in the Scope of This Privacy Policy section. Hey Now Records is not responsible for the privacy practices, content, or security of any third-party services and encourages visitors to review the privacy policies of those services before providing any personal information.

U.S. State Privacy Rights

Certain states in the U.S. provide (now or in the future) their state residents with rights related to their personal information. Consistent with these laws, Hey Now Records gives you options to access, edit, or remove certain information, as well as choices about how we contact you. Although some of these rights apply generally, certain rights will only apply to limited individuals or circumstances. To the extent that these laws apply to us and to you, you may exercise the following rights:

Right to Know and Access. The right to confirm whether Hey Now Records processes personal information about the individual and to request access to that information, including the categories and specific pieces of personal information collected.
Right to Correction. The right to request correction of inaccurate personal information.
Right to Deletion. The right to request deletion of personal information, subject to applicable legal exceptions.
Right to Data Portability. The right to obtain a copy of personal information in a portable and, to the extent technically feasible, readily usable format.
Right to Opt Out of Sale, Sharing, and Targeted Advertising. The right to opt out of the sale of personal information, the sharing of personal information for cross-context behavioral advertising, and targeted advertising. Right to Opt Out of Profiling. The right to opt out of profiling in furtherance of decisions that produce legal or similarly significant effects, where applicable under state law.
Right to Limit or Withdraw Consent for Sensitive Data. Where applicable, the right to limit or withdraw consent for the processing of sensitive personal information.
Right to Nondiscrimination. The right not to be discriminated against for exercising privacy rights, including through denial of goods or services, imposition of different prices, or provision of a different quality of service.

Exercising Your Privacy Rights

Eligible individuals may submit privacy rights requests by contacting Hey Now Records at privacy@heynowrecords.com or by using the privacy choices mechanism at heynowrecords.com/pages/privacy-choices.

Hey Now Records will verify the identity of any individual submitting a request before processing the request. Verification may require the individual to provide information matching existing records. Hey Now Records will not fulfill a request if the identity of the requestor cannot be reasonably verified. Where a request concerns order or payment information held by Sparkart as merchant of record, Hey Now Records will coordinate with Sparkart to fulfill the request. Hey Now Records remains responsible for responding to the requestor within the timeframe required by applicable law.

Authorized Agents

Individuals may designate an authorized agent to submit privacy rights requests on their behalf. Authorized agents must provide written authorization from the individual, and Hey Now Records may require the individual to verify identity directly. Authorized agents may submit requests by contacting Hey Now Records at privacy@heynowrecords.com.

Response Periods

Hey Now Records will respond to verified privacy rights requests within the timeframe required by applicable law. In general, Hey Now Records will respond within 45 days of receipt of a verified request, with the possibility of an extension as permitted by applicable law. If an extension is necessary, Hey Now Records will notify the requestor of the extension and the reason.

Appeals

If Hey Now Records denies a privacy rights request in whole or in part, the individual may appeal the decision by contacting Hey Now Records at privacy@heynowrecords.com with a description of the basis for the appeal. Hey Now Records will respond to appeals within the timeframe required by applicable law and will provide instructions for submitting a complaint to the applicable state attorney general or regulatory authority if the appeal is denied.

Additional Disclosures for California Residents

This section provides additional disclosures required under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), for California residents. The rights described in the U.S. State Privacy Rights section above apply to California residents, and this section supplements those disclosures.

In the preceding twelve (12) months, Hey Now Records have collected the following categories of personal information: (a) Identifiers (such as name, email address, phone number, IP address, and device identifiers); (b) Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) (such as name, address, telephone number, and financial information); (c) Commercial information (such as business contact information and transaction details); (d) Internet or other similar network activity (such as browsing history, search history, and information regarding your interaction with our Websites); (e) Geolocation data (inferred from IP address); and (F) Inferences drawn from the above categories.

Hey Now Records collects personal information from the following categories of sources: (a) directly from you when you provide it to us (such as when you fill out a form, register for an event, apply for a job, or contact us); (b) automatically when you visit our website and interact with our Services (through cookies, log files, pixels, and similar technologies); and (c) from third parties (such as event organizers, partner organizations, publicly available sources, and service providers).

Business or Commercial Purposes for Collecting Personal Information. Hey Now Records collects personal information for the following business or commercial purposes: (a) to respond to your inquiries and fulfill your requests; (b) to provide our Services and related information; (c) to send you marketing communications (where permitted by law); (d) to personalize your experience with our Services; (e) to improve and optimize our Services; (f) to detect, prevent, and address fraud, security, or technical issues; and (G) to comply with legal obligations.

Sale and Sharing of Personal Information. Under the CCPA, "sale" includes disclosing personal information for monetary or other valuable consideration, and "sharing" includes disclosing personal information for cross-context behavioral advertising. We may "share" certain personal information (such as Device Information and identifiers) with advertising partners through cookies, pixels, and similar technologies for targeted advertising purposes. We do not "sell" personal information for monetary consideration. You have the right to opt out of the sale or sharing of your personal information by using the Global Privacy Control as described above, adjusting your cookie preferences, or by contacting us at privacy@heynowrecords.com.

Notice of Right to Opt Out of Sale/Sharing. As described above, we may "share" your personal information with third-party advertising and analytics providers through cookies, pixels, and similar technologies for targeted advertising purposes. This may constitute a "sale" or "sharing" under the CCPA/CPRA. You have the right to opt out of such sale or sharing. To exercise this right, you may: (a) submit a request to privacy@heynowrecords.com ; (b) enable the Global Privacy Control (GPC) signal in your browser; or (c) adjust your cookie preferences through our website.

Rights of Residents of European Economic Area, United Kingdom, Switzerland or Canada

Persons residing in the European Economic Area (“EEA”), UK, or Switzerland (collectively, “EU Region”) or Canada, may benefit from a number of rights in relation to your personal information that we process. Some rights apply only in certain limited cases, depending on your location. Consistent with these laws, we give you options to access, edit, or remove certain information, as well as choices about how we contact you. Although some of these rights apply generally, certain rights will only apply to limited individuals or circumstances.

We provide adequate protection for the transfer of personal information to countries outside of the EU Region through one or more of the following methods: (a) we may rely on the European Commission’s adequacy decisions about certain countries, as applicable, (b) we may obtain your consent for these data transfers from the EU Region to the United States to other countries. Canadian residents have rights under Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA).

To the extent that these laws apply, you may exercise the following rights:

Right to Access. Note that much of the information you are entitled to know or access is disclosed in this Privacy Policy. With this said, you have the right to know about our information practices. You also have the right to access the categories of data we collect, with whom we share or sell that information, and, in some cases, what specific personal information we associate with you or your account.
Right to Rectification. You may request we correct or rectify inaccurate information we have collected about you.
Right to Erasure. You may request that we delete the personal information we have collected about you. Depending on the applicable law, in some cases we are required or permitted to retain your information, even if you validly requested we delete or erase it.
Right to Restrict Processing. If we process your information based on our legitimate interests as explained in this Privacy Policy, you may have the right to restrict processing in certain circumstances.
Right to Object. If we process your information based on our legitimate interests as explained in this Privacy Policy, or in the public interest, you can object to this processing in certain circumstances. Where we use your data for direct marketing purposes, you can always object using the unsubscribe link in such communications or changing your account settings.
Right to Data Portability. If you request a copy of your specific information then we will provide it in an easily accessible format.
Automated Decision Making. You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you, except for the exceptions applicable under relevant data protection laws. We do not use automated decision making or profiling.
The right to withdraw consent. If we are processing your personal information based on your consent to do so, you may withdraw that consent at any time. A withdrawal of consent will not affect the validity of our use of your Personal Information up until the point you have withdrawn your consent.
Right to Lodge a Complaint. You may be entitled to lodge a complaint with your data privacy regulatory authority.

We generally process personal information of those residing in the EU Region on the legal basis of our legitimate interests in performing the function or service you requested. Where appropriate, we may rely on alternate legal bases, such as your consent to certain types of processing. Where we process your personal information on the basis of consent, we will clearly obtain your opt-in consent.

International Data Transfer and Storage

Hey Now Records is based in the United States. However, we recognize that individuals located outside the United States, including in the European Economic Area (“EEA”), the United Kingdom (“UK”), and Switzerland, may interact with our Services or provide us with personal information—for example, by contacting us with inquiries. When we, or our service providers, transfer or store personal information from the EEA, the UK, or Switzerland to the United States or other countries that have not been deemed to provide an adequate level of data protection, we implement appropriate safeguards to protect your data in accordance with applicable law. These safeguards may include:

Binding contractual commitments with our service providers and processors requiring them to protect personal information to a standard consistent with the GDPR; and
Supplementary technical and organizational measures, such as encryption and access controls, where appropriate.
